Guevara v. CAMIN CARGO CONTROL, INC.

Solomon Guevara, a field inspector with Camin Cargo, brought this overtime pay case on behalf of field inspectors who received overtime pay under a Defendant’s half-time method called “Chinese Overtime” and received day-off or holiday pay.

The Court has already found that Camin Cargo must pay back overtime wages to inspectors paid under “Chinese Overtime” who received day-off or holiday pay. In a similar case against Camin Cargo, Brumley v. Camin Cargo, the Court found that Camin Cargo’ “Chinese Overtime” violated the law and ordered it to pay the inspectors who had joined that case the difference between overtime calculated at time-and-a-half and the overtime the Company paid under its "Chinese Overtime” method. We believe that the Court’s decision in the Brumley case will apply to this case, too.

Only the people who join this action by filing a consent to sue are eligible to recover in it. Inspectors who worked for Camin Cargo in the past 3 years, were paid “Chinese Overtime”, and received day-off or holiday pay can join this case by filing a consent to sue. In Brumley v. Camin Cargo Control, Inc., the Court found that Camin Cargo's "Chinese Overtime" violated the law and ordered it to pay back overtime wages calculated at time-and-a-half for all hours over 40 in a week. Click here to view the Court's Decision (Brumley Decision.pdf 114KB). Plaintiffs believe that the Brumley decision applies to this case as well.

It is important to know that only people who file a consent to sue in this case are eligible to recover back overtime wages in it. Click here to access the consent to sue (Consent to Sue.pdf 8KB).

It is also important to know that every week inspectors wait to file a consent to sue, they may be losing claims. That is because the statute of limitations on claims runs on a weekly basis. To protect your claims, you should file a consent to sue as soon as possible.
